Terms of Service
Effective May 26, 2026 · Last updated October 8, 2026
These terms govern your use of the Texian Trail mobile app (the “App”), the Trail+ subscription, and the account pages at texiantrail.app (the “Site”). By creating an account or using the App, you agree to them. If you do not agree, please do not use the App.
1. Who We Are
The App and the Site are owned and operated by RFT Media (“we,” “us”). Contact: support@texiantrail.app.
2. Your Account
- You must be at least 13 years old to create an account.
- Give accurate information and keep your password private.
- You are responsible for what happens under your account.
- Do not share your account, use someone else’s, or pretend to be another person or organization.
- You can delete your account at any time in the App (Profile, then Delete Account) or at texiantrail.app/account/delete.
3. Acceptable Use
You agree not to:
- Upload photos with nudity, violence, hate, harassment, sexual content, illegal content, or material that infringes someone’s copyright.
- Upload photos that show identifiable people, license plates, or private addresses without permission.
- Submit false location corrections or try to game check-ins or badges.
- Scrape the App or its API with automated tools.
- Reverse engineer, decompile, or modify the App.
- Get around the daily check-in limit or other access controls.
- Use the App or the Site to break any law.
We may remove content and suspend or close accounts that break these rules. We will usually tell you first, unless doing so would risk harm or the law prevents it.
4. Photos and Corrections You Submit
4.1 Permission You Give Us
When you submit a photo of a marker, a location correction, or another contribution, you give RFT Media a worldwide, non-exclusive, royalty-free license to host, store, copy, display, and adapt it (for example, resizing it or removing metadata) in the App and on texiantrail.app. You keep ownership and may use your photo anywhere else. We do not sell your contributions.
If you delete your account, your name is removed from your contributions. Approved photos may stay attached to their markers without your name.
4.2 What You Promise
You own the content or have permission to submit it, and it does not violate anyone’s privacy, publicity, or intellectual property rights or these terms.
Copyright owners can send takedown notices to support@texiantrail.app with “DMCA Takedown” in the subject line. We respond under the Digital Millennium Copyright Act.
4.3 Review
Every submission is reviewed by a person before it appears in the App. We may decline any submission.
4.4 Reporting and Blocking
To report a photo, press and hold it and choose Report. To stop seeing a user’s content, choose Block. Reports go to our review team.
5. Trail+
Trail+ is an optional, auto-renewing subscription.
5.1 What It Includes
- Unlimited daily check-ins (free accounts get 5 a day)
- Every curated guided tour
- Full-text search of marker inscriptions
- Satellite and hybrid map views
- Offline downloads by county
- A nearby radius filter
- A trail passport with detailed stats
5.2 Price
- Monthly: $2.99 (US), billed every month
- Yearly: $24.99 (US), billed every year
Prices appear in your local currency at purchase. Apple or Google processes the payment.
5.3 Renewal and Canceling
- Trail+ renews automatically at the end of each period unless you cancel at least 24 hours before it ends.
- Your store account is charged for the next period within 24 hours before the current one ends.
- You manage and cancel Trail+ in your Apple ID or Google Play account settings, not in the App. Deleting the App or your Texian Trail account does not cancel it.
5.4 Refunds
Apple and Google handle refunds under their own policies. For Apple, use reportaproblem.apple.com. For Google, open Google Play, then your account’s order history.
5.5 Restoring Purchases
On a new phone or after reinstalling, sign in and tap Restore Purchases in the App to get an active subscription back.
5.6 Free Trials
If we offer a free trial and you do not cancel before it ends, the subscription continues at the regular price. One trial per Apple ID or Google account.
6. No Advertising
The App does not show ads. If that ever changes, we will update these terms and the Privacy Policy first.
7. Ownership
- The App, the Site’s design, the Texian Trail name and logo, and our code belong to RFT Media. You get a personal, non-transferable license to use the App.
- Marker titles, inscriptions, and locations come from the Texas Historical Commission’s Texas Historic Sites Atlas. Texian Trail is an independent guide and is not affiliated with or endorsed by the Commission.
- Your contributions are covered by Section 4.
8. Disclaimers
THE APP AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, RFT MEDIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- Marker information may contain errors. Do not rely on the App for navigation in an emergency, and obey traffic laws and property rights when visiting markers.
- A check-in confirms only that your phone reported a location near the marker’s listed location when you checked in.
- We do not promise uninterrupted service. We may change or end the App, with reasonable notice for major changes.
9. Limits on Liability
TO THE FULLEST EXTENT THE LAW ALLOWS, RFT MEDIA AND ITS OWNERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR USE, ARISING FROM YOUR USE OF THE APP OR THE SITE.
Our total liability for any claim under these terms is limited to the greater of what you paid us in the 12 months before the claim or $20. Some places do not allow these limits; there, they apply only as far as the law allows.
10. Indemnity
You agree to defend and hold RFT Media harmless from claims that arise from your contributions, your use of the App or the Site, or your violation of these terms.
11. Ending Use
You can stop using the App at any time. We may suspend or close your account if you break these terms or the law. Sections 3, 4.1, 4.2, 7, 8, 9, 10, 12, and 13 continue after your account ends.
12. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be decided in the state or federal courts in Travis County, Texas, and you and we agree to their jurisdiction. If you live outside the United States, mandatory consumer protections of your country still apply.
13. Apple Terms
If you got the App from the Apple App Store:
- These terms are between you and RFT Media, not Apple, and Apple is not responsible for the App.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
- Apple’s standard license agreement also applies; where it conflicts with these terms, the more restrictive term applies.
14. Changes
We may update these terms. The date at the top shows the latest version. For material changes, we will email account holders before they take effect. Using the App after that date means you accept the new terms.
15. Contact
RFT Media Email: support@texiantrail.app For legal matters, put “Legal” in the subject line.
